Dr. Lamb’s Q&A Vault

Please read the Terms of Use for the Membership carefully and in their entirety before purchasing and using Dr. Lamb’s Q&A Vault (hereinafter referred to as the “Membership”).
The Membership and its Content are owned by BLAMBMD LLC. 

1. Definitions

“Company,” “We,” “I,” “Our,” or “Us” means BLAMBMD LLC.

“Content” means any and all written, visual, video, audio, digital, downloadable, replay, transcript, summary, index, chapter title, resource link, worksheet, workbook, guide, email, Q&A recording, edited clip, or other educational material included in or connected to the Membership.

“Membership” means Dr. Lamb’s Q&A Vault, including but not limited to Q&A recordings, edited clips, transcripts, summaries, chapter titles, resource links, written materials, downloadable resources, and other educational Content related to dementia medical decision-making.

“Participation,” “Participating,” “Using,” or “Use” means watching, reading, accessing, viewing, listening to, downloading, implementing, trying, attending, submitting questions for, or otherwise engaging with the Membership or its Content.

“Q&A Session” or “Live Q&A Session” means a live educational session hosted by Dr. Lamb or BLAMBMD LLC where participants may submit questions, attend live, use chat, speak, appear on camera, or otherwise participate.

“Q&A Replay” means a recorded version of a Q&A Session that may be shared by email, posted inside a course or Membership area, included in Dr. Lamb’s Q&A Vault, or otherwise made available by BLAMBMD LLC.

“Submitted Information” means any information voluntarily provided to BLAMBMD LLC, including but not limited to questions, forms, survey responses, emails, chat messages, comments, live Q&A participation, voice, image, displayed name, username, or other information shared through the Membership, Q&A Sessions, Q&A Replays, website, courses, services, products, or educational materials.

“Your Person” means the person living with dementia or any other person you are advocating for, asking questions about, or making decisions for.

“You,” “Your,” “User,” “Client,” or “Member” means the purchaser, viewer, participant, and/or person using the Membership.

2. Consent to Terms

By purchasing, accessing, viewing, using, or participating in the Membership, you voluntarily agree to act in accordance with, agree to, and abide by these Terms of Use.

If you do not agree with these Terms of Use, do not purchase, access, view, use, or participate in the Membership.

3. Membership Access

Your purchase gives you access to Dr. Lamb’s Q&A Vault according to the access terms listed at checkout. Access may be offered as a one-time purchase, annual access, monthly subscription, founding member access, or another access model as stated on the checkout page.

Unless specifically stated otherwise in writing at checkout, your purchase does not guarantee lifetime access to any specific Q&A recording, replay, transcript, index, resource, download, live session, or Membership feature.

BLAMBMD LLC may add, remove, update, edit, reorganize, replace, discontinue, or modify Membership Content at any time. BLAMBMD LLC may also change the platform, hosting service, video player, download format, index format, or delivery method used to provide the Membership.

4. Recorded Q&A Sessions, Submitted Questions, and Member Participation

The Membership may include recorded Q&A Sessions, edited clips, written questions, transcripts, summaries, indexes, educational examples, replay pages, chapter titles, resource links, and other teaching materials created by BLAMBMD LLC.

Q&A Sessions may include real questions, stories, audio, video, chat, or other participation from dementia medical decision-makers. Q&A Replays may be shared with Dr. Lamb’s email list, made available through replay links, included in course or Membership areas, and/or included in Dr. Lamb’s Q&A Vault or other BLAMBMD LLC educational materials.

When Q&A recordings are included in Dr. Lamb’s Q&A Vault, BLAMBMD LLC may take reasonable steps to reduce identifying information, such as covering participant faces, visible names, usernames, or chat when possible. However, because Q&A Sessions are real educational discussions, BLAMBMD LLC cannot guarantee that every voice, story, question, or circumstance will be unrecognizable to the participant or to someone who already knows the situation.

If you submit a question, attend a live Q&A Session, participate in chat, speak during a session, turn on your camera, display your name, or otherwise provide information to BLAMBMD LLC, you understand that your participation may be recorded, edited, clipped, replayed, transcribed, summarized, paraphrased, de-identified, indexed, organized, and included in the Membership or in other free or paid educational materials created by BLAMBMD LLC.

You understand that the Membership may be a paid educational product.

Please do not submit or share information you consider private, confidential, or unnecessary for educational discussion. You should not share full names, dates of birth, addresses, medical record numbers, facility names, exact locations, hospital names, physician names, or other identifying information unless you are comfortable sharing that information in a recorded educational setting.

If you submit or share information about another person, you confirm that you have appropriate permission or authority to share that information, or that you understand BLAMBMD LLC may edit, paraphrase, summarize, remove, or de-identify the information before using it for educational purposes.

BLAMBMD LLC is not required to answer, publish, replay, include, retain, or continue providing access to any question, comment, story, chat contribution, live participation, recording, replay, or Membership Content.

5. No Confidentiality Promise for Live Q&A Participation

Live Q&A Sessions are educational group settings. They are not private medical visits, legal consultations, therapy sessions, or confidential advisory sessions.

Although BLAMBMD LLC may take reasonable steps to edit, de-identify, or limit unnecessary identifying information in Vault recordings when possible, you understand that live participation may be visible or audible to other attendees and may appear in a recording if you choose to participate by speaking, using chat, turning on your camera, or displaying your name.

If you do not want your face, voice, name, chat, or personal story included in a recording, you should keep your camera off, remain muted, avoid using chat, and submit questions in writing when that option is available.

6. Privacy Policy

Your use of the Membership is also governed by BLAMBMD LLC’s Privacy Policy. The Privacy Policy explains how BLAMBMD LLC may collect, use, store, process, share, and protect information connected to your use of the website, email list, Q&A Sessions, Q&A Replays, Dr. Lamb’s Q&A Vault, checkout pages, payment processors, forms, analytics tools, video hosting tools, and other services.

7. No Physician-Patient Relationship

Dr. Lamb is a licensed physician, but she is acting through BLAMBMD LLC as a physician educator, not as your physician or your person’s physician.

Your purchase, access to, use of, or participation in the Membership does not create a physician-patient relationship between you, your person, Dr. Lamb, or BLAMBMD LLC.

The Membership does not include diagnosis, treatment, medical record review, medication management, individualized medical advice, emergency medical guidance, or care coordination.

8. Disclaimer: Educational Information Only / No Medical Advice

The Membership is for informational and educational purposes only. BLAMBMD LLC does not offer medical advice through the Membership. Any Content accessed through BLAMBMD LLC Memberships, programs, courses, services, Q&A Sessions, Q&A Replays, or educational materials is for informational purposes only and is not intended to be used as a substitute or supplement for diagnosis, treatment, or professional medical care.

Do not ignore or delay obtaining professional medical advice because of information accessed through or otherwise obtained from BLAMBMD LLC.

Do not use or call upon BLAMBMD LLC, Dr. Lamb, the Membership, Q&A Sessions, Q&A Replays, or the Q&A Vault during a medical emergency. Call 911 in case of emergency.

For any new symptoms, new medical issues, diagnosis, treatment, medication questions, medical orders, changes in care, or management of existing medical issues, contact your or your person’s physician or qualified medical professional.

You are responsible for discussing and clearing any changes to your or your person’s health care plan with the appropriate physician or qualified medical professional before implementing any suggested, discussed, or considered changes, additions, subtractions, substitutions, or alterations. This includes, but is not limited to, medical treatments, medications, use of medical services in or outside of the hospital, medical order forms, lifestyle changes, food intake, supplements, exercise regimen, and other health-related decisions.

BLAMBMD LLC has not promised and is not obligated to act as a therapist, attorney, accountant, financial advisor, publicist, case manager, care coordinator, or any other licensed or registered non-medical professional. The Membership does not provide legal, financial, accounting, therapy, psychological, or professional advisory services. You should consult appropriate professionals in your jurisdiction for legal, financial, accounting, therapy, or other professional advice.

Although BLAMBMD LLC does its best to provide accurate and useful educational information, BLAMBMD LLC does not guarantee that all Membership Content is accurate, complete, current, free of errors, safe, effective, or applicable to your specific situation.

9. Assumption of Risk

You should use your best judgment when using information provided in the Membership. Your use of the Membership and its Content is done at your own risk.

It is your responsibility to discern the risk of using, applying, or relying on information provided through the Membership. You assume responsibility for your actions, choices, inactions, decisions, and results related to the Membership.

10. Intellectual Property Ownership

The Membership and its Content, including but not limited to Q&A recordings, edited clips, transcripts, summaries, indexes, chapter titles, resource links, replay pages, written materials, worksheets, workbooks, guides, downloads, videos, audio files, graphics, designs, documents, information, templates, and other materials are intellectual property owned by Brittany Lamb and/or BLAMBMD LLC.

You may not copy, reproduce, distribute, publish, upload, download unless expressly permitted, sell, resell, teach, train from, create derivative works from, forward, share, license, or otherwise use the Company’s intellectual property in connection with the sale, distribution, or promotion of any product, program, service, Content, training, or business without the prior written consent of BLAMBMD LLC.

Misappropriation, copying, distribution, or unauthorized use of the Company’s intellectual property may result in enforcement action to recover damages and/or protect BLAMBMD LLC’s intellectual property rights. BLAMBMD LLC reserves all rights and remedies available under law.

11. Permitted Personal Use and No Sharing

You may use what you learn in the Membership for your own personal education and for discussions with your family, care team, clinicians, attorney, financial advisor, care manager, or other professionals involved in your person’s care.

You may not share your login information, password, replay links, downloads, recordings, transcripts, worksheets, written materials, Membership Content, or Membership access with anyone else unless BLAMBMD LLC gives you written permission.

You may not distribute, copy, forward, publish, upload, share, resell, teach, train from, or otherwise make the Membership or its Content available to anyone who has not purchased or otherwise been granted access by BLAMBMD LLC.

If you share your password, login information, replay links, Membership access, or Membership Content with anyone who did not purchase or receive authorized access to the Membership, BLAMBMD LLC may remove you from the Membership immediately and no refund will be issued.

12. Termination of Access

BLAMBMD LLC reserves the right to suspend or terminate your access to the Membership without refund if you violate these Terms, share login information, distribute Membership Content, attempt to copy or resell Membership materials, misuse the Membership, harass or abuse other participants, submit inappropriate Content, or use the Membership in a way that creates legal, privacy, safety, reputational, or operational concerns.

13. No Claims Made Regarding Results

Any current or past-client testimonials, statements, stories, examples, or educational examples used by BLAMBMD LLC are examples only. They are not guarantees that you will experience or receive the same or similar results.

Each person, family, medical situation, legal situation, financial situation, and care context is unique. Nothing in the Membership shall be interpreted as a promise, warranty, or guarantee of any particular medical, legal, financial, caregiving, advocacy, quality-of-life, family, emotional, or decision-making outcome.

BLAMBMD LLC is not responsible for the success or failure of your decisions, your person’s health, your person’s outcomes, or any other result of any kind that you may experience as a result of your participation in or use of the Membership.

14. No Warranties, Guarantees, or Representations

The Membership is offered “AS IS” and without representations, guarantees, or warranties of any kind, either express or implied, to the fullest extent permitted by law.

BLAMBMD LLC does not make any representations, guarantees, or warranties regarding the Membership, including but not limited to your future health, your person’s health, medical outcomes, legal outcomes, financial outcomes, family outcomes, decision-making outcomes, access availability, uninterrupted service, or the applicability of Membership Content to your specific situation.

To the fullest extent permitted by law, BLAMBMD LLC disclaims all warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

15. Release, Indemnification, and Hold Harmless

To the fullest extent permitted by law, BLAMBMD LLC expressly disclaims liability for any direct, indirect, incidental, consequential, special, exemplary, or other damages suffered by you related to your purchase, access to, use of, or participation in the Membership, its Content, the website, Q&A Sessions, Q&A Replays, or any other information obtained from BLAMBMD LLC.

By purchasing, accessing, using, or participating in the Membership, you agree to release, defend, indemnify, and hold harmless BLAMBMD LLC, Brittany Lamb, employees, agents, contractors, subcontractors, shareholders, directors, officers, coaches, assignees, licensees, affiliates, and successors from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, losses, and/or costs related to or arising out of your purchase, access to, use of, or participation in the Membership; your breach of these Terms; your misuse of the Membership; or your violation of any obligation, warranty, covenant, or representation set forth in these Terms.

16. Refund Policy

Due to the structure and digital nature of the Membership, refunds will not be issued once the Membership is purchased unless otherwise required by law or expressly stated in writing at checkout.

17. Billing Concerns and Chargebacks

If you have a billing concern, please contact BLAMBMD LLC first at brittanylamb@blambmd.com so we can try to resolve the issue.

BLAMBMD LLC reserves the right to dispute improper chargebacks and to suspend access while a payment dispute is pending. Initiating a chargeback does not cancel any active subscription unless the subscription is separately cancelled according to the cancellation instructions provided at checkout or inside the Membership.

18. Payment, Purchase, and Subscription Terms

When you pay for the Membership by credit card, debit card, PayPal, Stripe, or another payment method offered at checkout, you authorize BLAMBMD LLC and/or its third-party payment processors to charge your payment method for the amount owed.

Your information, including payment and contact information, may be collected and processed by third-party payment processors such as Stripe, PayPal, or similar services. These third-party payment processors may have privacy policies, security practices, and terms that are different from BLAMBMD LLC’s. BLAMBMD LLC is not responsible for the independent policies, security practices, or actions of third-party payment processors.

If the Membership is offered as a recurring subscription, the checkout page will state the billing frequency and amount. By purchasing a recurring subscription, you authorize BLAMBMD LLC and/or its third-party payment processors to charge your payment method on a recurring basis until you cancel according to the cancellation instructions provided at checkout or inside the Membership.

Cancellation stops future billing but does not provide a refund for amounts already paid unless otherwise required by law or expressly stated in writing at checkout.

19. Third-Party Platforms and Technology

The Membership may be delivered through third-party platforms and service providers, including but not limited to website hosting services, checkout processors, email platforms, video hosting platforms, webinar or meeting platforms, course platforms, Membership platforms, analytics tools, advertising platforms, payment processors, and customer support tools.

These may include, but are not limited to, FG Funnels, Vimeo, Zoom, Kit/ConvertKit, Stripe, PayPal, Google Analytics, Meta/Facebook, and similar services.

BLAMBMD LLC does not guarantee uninterrupted access, error-free operation, compatibility with every device, or permanent availability of any third-party platform. BLAMBMD LLC will make reasonable efforts to maintain access but is not responsible for outages, technical issues, platform changes, internet problems, device incompatibility, payment processor issues, video hosting issues, email delivery issues, or other circumstances outside its control.

20. Arbitration Clause:

If you have any complaint or should any issue arise in the use of the Membership, please contact us directly first by emailing Brittany Lamb at brittanylamb@blambmd.com.

However, if we are unable to amicably resolve your dispute in that manner, you agree that you and Brittany Lamb and BLAMBMD LLC shall submit your dispute to binding arbitration with the American Arbitration Association, before an arbitrator that is mutually agreed upon, in accordance with the American Arbitration Association’s (“AAA”) rules.

By agreeing to this term, you hereby agree and understand that you’re waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 20 miles of Fairfax, Virginia.

If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court in the State of Virginia. The only award that can be issued to you is a refund of any payment made to BLAMBMD LLC for the applicable Membership. You are not permitted to seek additional damages, including consequential or punitive damages.

21. Limitation of Liability:

To the fullest extent permitted by law, Brittany Lamb and BLAMBMD LLC are not responsible or liable in any way for any damages, injuries, harm, death, losses, claims or consequences you experience directly or indirectly from your purchase, access to, use of, participation in the Membership or its Content.

BLAMBMD LLC does not assume liability for damages, injuries, harm, death, misuse of, or failure to properly use the Membership or its Content due to any act, or failure to act, by you.

IN NO EVENT SHALL BLAMBMD LLC or BRITTANY LAMB BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, INCIDENTAL, OR CONSEQUENTIAL DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

22. Changes to These Terms

BLAMBMD LLC may update these Terms from time to time. The updated Terms will be posted on the website, checkout page, or Membership platform with an updated effective date. Continued use of the Membership after updated Terms are posted means you accept the updated Terms.

23. Severability 

The provisions of these Terms of Use shall be deemed severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision hereof. If any Section, subsection, sentence, or clause of these Terms of Use shall be adjudged illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on the Terms of Use as a whole or on any Section, subsection, sentence, or clause hereof not expressly so adjudged.

24. Entire Agreement

These Terms of Use contain the entire agreement between you and the Company. There are no other promises or conditions in any other agreement (oral or written) between you and the Company.

25. Choice of Law and Venue

These Terms of Use shall be governed by the laws of the state of Virginia. Any action brought by any party arising out of or from these Terms shall be brought within Virginia, County of Fairfax.

By purchasing, accessing, using, or participating in the Membership, you agree to these Terms of Use.
